If I remember the situation correctly, the guy financed a machine through AGCO but he made payments to a third party that went bankrupt. Then he blamed AGCO for his mistake.

This site has nothing to do with AGCO. It is a bunch of guys who talk about combines. I recall your buddy made all sorts of uncorroborated charges about a finance company wanting payment for a machine he bought. And he was unwilling to provide any details. The rule in business is a borrower is expected to pay back what he borrows or the lender might take a dim view of the situation.

Has me "second guessing" my business practices! I often paid my local IH dealer (years ago) direct rather than sending a check in the mail to IHCC. I guess I was lucky, although the check was always made payable to IHCC! I guess it's a matter of "good business practices" vs. "trust". Good business practices wins every time!

Sad to say we live in a monetary society and its also sad that is not based on a good neighbor system anymore. I will be the first to admit I want that system back so bad but it just isnt going to happen. In this (business) anymore you have to dot the I's and cross the T's and be careful who you are doing it with. I used the honor system on ebay, bought a gravel truck and asked specifically the conditions of it. I was informed it was a good used vehicle but was wrecked. Unfortunately it was more than wrecked, it had been used to haul fertilizer and had rust all over. I drove 500 miles to pick it up and decided I would hold up my end of the bargain because I did know it was used, but didnt know it was used for other purposes than gravel. I was upset and yes I do feel like I got a lil bit took on the deal and I also learned never to trust someones word on certain things. In the good old days these guys would be hung I guess, but thats the honor system and we dont use it today. Yes his dealer should have been hung or else returned the moneys to the propers. I hear of alot of livestock barns and grain dealers that play the board and loose alot of customers money. My advice I give I wish I would use myself more often but even I take a chance now and then and get burnt from it. Im sorry I dont feel its a machinery manufacturers responsibilty to take care of illegitimate business deals. That dealer was responsible for this dispair from what I understand, Agco should go after the dealer as well but probably wouldnt get anything out of him.

Tom you have no clue about it so dont make judgement against what he said or didnt say.You act as if you know what the deal is and that he is trying to get out of paying for something. So before you talk get the facts straight. He bought a combine from our dealer, the dealer didnt make the payment to pay it off of his floorplan so now Agco wants payed again or the combine back.So you tell me he should be alittle p.o.ed at the whole deal. Would you pay for your combine again or let them have it back. IG

Without knowing circumstances of the Agco dealings, only thing I can say if the contract was with Agco, payments should be made to them, not a dealer.Contracts have that printed on them in clear bold letters.

Not making judgement, but if the customer has all the documentation, including cancelled check and dealer contract with correct serial n,wouldn't seem Agco has a leg to stand on.
